Doesn't matter. Value is value. You go to jail based off of price. Guns are stolen for profit and selling. Murders don't go around breaking into cars in hopes of finding a gun to go kill someone. Premeditated murder isn't as popular as you think haha.

I dont think you got lemons, I am in the process of switching these stock tires out myself because i have never had such a horrible experience with a set of tires as these. I find that when the weather is even moderately cool outside they have absolutely no traction whatsoever and in the wet they are even worse. I am contemplating getting michelin pilot sport as3's.

Is it usual protocol for an insurance company to just replace with stock tires? I thought they have to replace what you have on at the time of loss.

They have to pay OEM value, you can decide to do whatever you want with it.
How the OP ended up with a set of stock everything without making a few grand on the side, I will never know. I'm sure the dealer's owner was laughing his áss off

This happened to me back in september, it was a bitch to tow had to source another spare to even attempt to tow it. But glad your dealership helped you out.

I know that's what I thought I tracked down 2 stores that had the tires in-stock I sent the guy handling my car the estimates and he gave me a lame reason why they can't purchase from them.

its very simple....what you just described that's called defrauding.

Dealer might be laughing his *** off, but i'm sleeping at night without a guilty conscience.

I was very curious so i just looked through my insurance policy and maybe things are different in canada but my policy states they must replace the equipment that was on the vehicle at the time of loss. Now this is where things can get a little crazy because whats to stop somebody from creating a huge list of high end items and declaring the loss-lol

Um... No it's not...
Insurance paid $7000 to the dealer. Meaning they were willing to cut you a check for $7000 and you could get it fixed however way you see fit. Because it is your car, you own it, you do what you want. Like them not getting the tires you want, LOL, as long as the tires you want are cheaper than OEM, I don't know why you'd stand for that.
And here's my price replacement breakdown if you took a check for $7000

Price you can get everything, shipped: Nismo wheels $1989, plus center caps, $240, plus TPMS, (let's say) $400, (let's say) Michelin PSS installed WITH a Costco Business membership $1500

Add that up $4129, I REALLY doubt the damage done to the car was $2871, and you'd lawfully get to keep the remainder.

What the dealer did is charge $1000/wheel, FULL retail or more, accuse him of defrauding the insurance company

I have no problem posting the estimate, however your numbers are a bit off.
Also Statefarm wrote the check to the dealership and myself in the "Pay to the Order" section so am I in a bind with them?

Please read my previous post, i shopped around.
My hands were tied, State Farm did not give me a choice they made the check out to my name and the dealerships.

I'm still financing the car, the bank currently owns the car so I'm guessing that's why they couldn't cut the check solely in my name.

Op never got ripped off at all. As far as I see it he got his car back to the way it was which is what insurance is for. I find it hilarious that people think that not gaining more in the end is getting ripped off lol!

Not exactly, you are right, but why let the dealer make a profit?
Either I make the profit because I'm the one paying for the damn insurance every month and not using it, or I guess you have insurance keep it... If you believe a bit too much in Karma. (But you just got your wheels jacked, so... Let's assume not)
Oh yeah, ESPECIALLY when I have to pay the deductible, you can bet your ASSSS I'm going to make sure MY loss is covered
