I don't think so..........based on the pictures and timing there are at least three car lengths between you and the "unseen" SUV you alledge was going to hit you. There is plenty of time for the SUV to avoid you...unless of course the SUV was barreling down on the intersection at 70 in the 35 zone which I doubt of course.
Unbelievable how a person will rationalize their accountability away. Pay the fine, take the points and quit  about it.
