They should have totaled it. I drowned my 350z and spent 3 months back and forth with the dealer having new parts replaced. The insurance wouldn't put in a new engine, so they found one in a parts salvage place and it was a POS.

I spent enough time at the dealer that I had intimate knowledge of the family of the guy that drove the courtesy van.

I finally gave up. That is why I now own a 370z.

Your insurance is ghettoer than the OP's! They used USED parts to fix your car?!??!

Adjusters can be a real PIA. They wanted to use an aftermarket cat and the dealer wouldn't do that. They ended up turning it in as a warranty repair to get me a new cat. The dealer found a used engine with 10,000 miiles, but the adjuster forced them to take one with 25k, which was a POS.
In hindsight, I'd have done things a lot differently, but in the heat of the moment, things don't always work out.
It was a HUGE learning experience.
