Cruise Control not engaging, should this be under warranty fix

I have posted few threads regarding my Cruise Control not engaging.

Wondering if this a warranty fix through the Nissan dealer ?

Well, if it's under the 3 year/36K miles and it's between the bumpers, it should be covered!
