He said/she said doesn't hold up very well in court. Without even a police report, you can't even really prove anything. I hope all works well for the OP, but I will always advise to properly document and report any accident.

I've handled claims for many many years for both a private company and an insurance company. Always call police and get a police report. Even if the police refuse to respond they will have a record that you called which your insurance company can check out if need be. As important, get a WITNESS name and phone number.
I've seen too many claims where the vehicle that did the "rear ending" contends the other vehicle was backing up and caused the crash believe it or not. The fact you got a written statement signed by the driver may have saved you from future problems in this claim. Good job! |

Why do people put themselves in a bad position to make things easier on the person who hit them? Police report and insurance always.

damn! all bad, but don't worry it will get fixed one way or another. New bumper or a repaint should be good as new. If its really deep, however, repaint might not look as good..so maybe look into just getting a whole new bumper, perhaps from someone here on the forum.
I am always scared when I have a car behind me too close when I am about to slow down and make a turn. I either hit my brakes like 100 times to make it blink and hopefully catch their attention, or I turn as fast as possible in order to be on the safe side. You just can't trust much of the general population out there these days -_-. its annoying anyways, good luck! Now I'm craving a burrito.. |

Early '12 I was driving my new '11 Z that had just passed break-in miles. A guy rear ended someone very hard in the far left lane of the local interstate bypass. It's essentially a four lane racetrack all the way around Indy. I was in the far right lane. He lost control and swerved over and clipped my left front fender with his right rear. The police were called. The officer decided that since I was in a Red Z Roadster I must have been racing. (Against a beater Malibu. Yeah, right.) He wasn't interested in listening to anything. The claims eventually went to mediation. I had been testing out a GoPro mounted on the windshield, which officer not-all-that-friendly wasn't the least bit interested in. I paid the ticket - whatcha gonna do? I sent the video to my insurance company. He was found to be 100% responsible. I'd have still called the police if someone else hadn't, but it doesn't always work out all that well. Perhaps Mrs. Officer had a headache the previous night? Anyway, OP, good luck. And as everyone else is saying, involve 'em and hope for the best.

Thanks! The insurance asked me to get a quote from any body shop I want. I'm thinking of Nissan dealer because I know they can match the factor paint. I heard Mag Black is a hard color to match so I wouldn't risk it by having a local shop do it.

As for paint match, take it to any specialist, they can match the paint there or buy it directly from Nissan I would think. If you want to take it to the dealer that is fine, but I would check out the facility to see how it looks. Treat it as if it were a paint and body shop not a dealer though. You should get descent access to where the cars are being prepped and fixed. I would take it to a really reputable shop with good painters and great reviews. |

Good news! Her insurance company is accepting the liability and I'm covered. Total estimate for my rear bumper is $1,000. Thank god it worked out flawlessly
