a few of my buddies go every weekend to the street races in their hemi trucks... they have a good bit of work, programmers, exhaust, gears, torque convertors, wide bands, intakes, etc... if they are good with their 60 foots but i always catch them and pass them.. so with just exhaust he has no chance...

what if, and i know this is going to sound crazy, but what if there was a situation in which you need to suddenly stop, like i dont know, maybe a kid running out in front of you, or an animal jumping out in front of your car or something falling off a car, or dare i say it, when a car suddenly stops in front of you because they had to stop suddenly in order to keep their family safe all it takes was "i thought i saw a road hazard in front of my car"(and it can be anything from a plastic bag, to a small toddler walking out on the street) and you have won the lawsuit because the driver who rear ended you wasn't maintaining a safe distance no matter what you want to think, slamming on your bakes is not and never will be illegal because outlawing that will cause all kinds of safety issues to anyone in the car |

Brake checking someone is illegal in many states. A police officer would have to watch the whole thing to cite you for it I would imagine.

there is no standard for what situation you have to brake for, so hypothetically if you were to see a squirrel run out in front of your car, and slammed on your brakes and the person behind you happened to rear end you, you would not be at fault now if you intentionally made someone rear end you(IE cutting the guy off than slamming on your brakes), you would be at fault because you are the one who caused the accident and you will get in a whole legal mess because insurance fraud is illegal |

If you are witnessed by a third party slamming on your Brakes for no reason other than to cause an accident, it is road rage...And you will fix your own car at the very least.. But truly nice try trying to cherry pick one sentence...

Lol, well for one thing if someone is tailgating me I'm not going to slam on my brakes anyways... I don't want them smashing into my car!! Even though it would be their fault and their insurance has to cover it, you still have a smashed up car.

A good question would be, "Is it legal to intentionally cause an accident " ?
If a third party witnesses it , then the court will decide...They will have to prove intent...If the third party witness that has no Dog in the fight, says that you were mad, aka, Road rage, be prepared to fix your own car... And for sure it is childish to brake check someone...That means they got under your thin skin.... From what I understand, the tailgater will cited for following too close, but the police, if they have an independent witness, can arrest you for reckless driving for Intentionally causing an accident due to road rage....

In Texas you'd be cited for improper stopping if you intentionally brake check someone and cause an accident.

Talked to my daughter who is a cop, slamming on your brakes without reason is illegal, and if it can be proven that there was no reason to slamm the brakes, the one running into will be at no fault! Will end up in court with lots of lawyer bills for either side I guess, so not it's not worth it.

It sounds like to me if, one is tailgating and the other slams brakes, they are both at fault hence cancelling each other out. So they would be both at fault. The second ticket would be given to the tailgater. Which is also ILLEGAL!
Anyway fvck aggressive pickup trucks. Engine braking, no law against that. Great debate guys. All points valid.

What if a rabbit or other small animal ran out on the road and the witness didn't see it? What if you thought you saw a small animal out on the road and slammed on your brakes? You can't possibly tell me that you can be held liable for something that you have no control over. Now if you were to cut someone off because they cut you off than brake check them, the party who rear ended you will have a case. But someone can not be held liable for just slamming on their brakes and being rear ended by a tailgater. Oh and I really don't care if I cherry pick one statement, you posted an incorrect statement and I am correcting you EDIT oh and FYI, i only quoted that sentence because i agreed with the rest of your post, if you brake check someone, you would be at fault because you attempted to cause an accident, but slamming your brakes in its own is not illegal Last edited by luigi90210; 06-08-2013 at 10:43 PM. |

And then if you try to lie and say you saw an animal when the witness knows you were in a road rage, that is insurance fraud...Lying to your insurance to prove a point to the tailgater...Good luck with that.... Don't get your panties in a bunch....The next tailgater will make you angry soon enough...
