Summons for loud exhaust?! (NYC)
 
So last night I was driving through Times Square and as you could imagine there was a good amount of traffic so I couldnt/wouldnt be driving fast or reckless. Well as im coming up to a red light to turn right the car it self down shifts from 3rd down to 1st to a complete stop. As im waiting for the light to turn green a cop comes up to my window askin if that was necessary and ask for my licence and to pull over. Im so confused at this point, so I pull over shut the car off windows down blinkers on. Cop comes up to my window and ask why i revved my engine? I told him I did nothin of the sort the revs might of gotten up to 2k rpm from it down shifting but thats really it.

He takes me info and PBA cards and goes missing for 15 mins. When he comes back hes basically throws my documents back at me and tells me not to do that S*** again. When I see he gives me a summons for loud exhaust!!! Court date for 6/17/13.

On the summons it says white Infiniti, not Nissan. Also I am licenced in Jersey and car is registered in Nj aswell.

What do you guys think I should do?

NYC FASCISTS... Thats why i left home... Dont get me started

In NYC, if the info is wrong on the ticket it gets dismissed. I would fight it though either way if your exhaust is stock or your aftermarket has resonators on it.

Then i would write a complaint on the cop for abuse of authority.

PS PBA cards don't get you outta shyt in NYC anymore.

We don't have cops in Ny. We have cops in Tx. In NY we have organized crime with badges.

First off the NYPD as a whole are mindless drones who can't wipe their *** without an order to do it. Either way they are losers who weren't popular in high school, see you in a nice car, and they can actually hate on you and make your day worse. Take it to court and fight the ticket. There is no way they can prove this. What happens when a lambo or ferrari comes through times square??? that exhaust doesn't ring through the streets??

the other night I Was driving down to get to CPW and a cop just blocked the intersection with her prius cop car so she could have a conversation with a beat cop. They took about 5 light changes to finish their convo, and when I honked at them, they threatened to arrest me!

Good times in nyc!

If the info is wrong, then most likely it gets tossed.

Also, NYC has a no aftermarket exhaust law. I had the same thing happen with my old car with an HKS. Not sure how they handle it if you have jersey plates or if you have an aftermarket or OEM. If you can prove that you have an OEM exhaust, then it'll get tossed.

Downshift from 3rd to 1st? Usually I just put it in neutral and coast/brake to stop.

If they don't have the correct information than the case should be dismissed.

A buddy of mine had a ticket with the wrong year and it was dismissed as soon as he went up to the judge.

No but there are laws on noise pollution. That's what the bloombergs storm-troopers are basing the ticket on.

I must say though my car is loud as hell in the city but at that time and moment I wasn't really makin noise I didn't even get past 3k rpm... I'm goin to call the court today cause I'm not goin to court for such a stupid thing.. Tolls and gas isn't cheap lol

I've had m fair share of run ins with the police. Despite all the negative hatred here on them, most of the time I have a fine experience with them. I do have multiple PBA cards, and typically they do work if im not being a complete douche driving or attitude to them. And even times ive forgotten my wallet and didnt have them on me, if you are polite to them they usually give you the same tone and respect back. Not saying that means you are getting out of the ticket, but not every cop is as stated from the above experiences.

Its no different than any other job, there are good people and bad people. I'm sure its just the same as anyone whos had a mechanic try and screw them and lie to them about what they need fixed and what not, when its really fine.

but back on topic, fight the ticket if its worth you paying gas and tolls to come back. Especially if its not points on your liscence, just go by whatever is cheaper. if its cheaper to just pay the fine and not the money spent to travel back just do it. otherwise, unless the cop has a decibal reading on your car then whats his subjective opinion is loud compared to someones else with no hard numbers to prove it was above any specific law numbers. I dont know if there are specific numbers for nyc, but i can find out from a buddy if you want me to.

i think the cop put infiniti on purpose so it frightens you and gives you headache to have to go to court for something that he knows will be tossed.

he probably also knew he couldn't do anything about it to prove you even rev'ed that high at all (maybe?)

Funny part about being pulled over was the amount of people took pics next to my car haha should of charged people $5 per picture

What is the exact violation that he wrote on your ticket? and the violation # if you can read it. That will make it easier for me to get from my friend what the ticket really means and how easy or hard to get out of it is.

Under "in violation of section" the number is 24-236(A)
"Title of offense" unreasonable noise from exhaust.

I had a similar summons, not sure if it's the same violation or not though. I went to court, showed the judge a fix-it ticket that I had an OEM exhaust and it got tossed. In and out in about an hour depending on how many people were there.

I would report the Cop to Internal Affairs and say he was abusive and Unprofessional.

D bags like this usually have more than one run in with IA and you can let HIM explain his actions to guys that like to bust the balls of dirty Cops...Give him a taste of his own medicine..

And I LOVE the Police in my Area....So My post comes from a PRO Cop guy...But this NY Cop needs his wings clipped...Good Luck

Your probably just going to have to pay the ticket unless you have the time and money to waste a whole day in NYC and court to fight it.

The fine is probably less then the cost of taking a day off from work and all the other costs.

Most of this BS enforcement comes the Bloommy and all the crazy sport , bikes and tunner cars that would do stunts and rev up their engine in mass display in the TS area.

No he doesnt. He lives in NJ, He can fight it through phone and mail. It's a BS ticket and his ticket says infiniti on it. In NY, thats automatic dismissal.

Just for the reference. If this does go to court you may be able to fight it through procedure and nail the cop during cross reference. That's if it ever gets that far. I'm not familiar with NY law =\

For those who do not live in NYC let me help you understand the stupidity...

In NYC they want to tell you how much soda you can legally buy/drink at one time (if you are too stupid to know soda isnt healthy, I Want you to meet my Friend Mr. Darwin) I don't need my local government forcing me to be healthy.

Cigarettes... yup you may be stupid if you smoke, but you are even dumber to smoke in nyc for 15-18 dollars PER PACK. Not to mention its going to be illegal to display the cigarettes in nyc, out of sight out of mind is our philosophy.

To be in NYC is almost a guarantee for at least one Cop with bad intentions to engage you in some moronic conversation. Don't accidentally photograph them for your scrapbook or they may confiscate or destroy your camera.

I'm surprised NYC would have a parking ticket, summons fight by phone or mail system, for tickets. I lived in NYS for 50ys and only left 2yrs. ago

What is the link to the resolution system ?

Most tickets in NYS have a guilty or not guilty plea by mail , with one little box for a explanation to go along with a guilty plea with a reason, but this does very little , and most times you will be just simply fined by a court clerk and ordered to pay online or by MO etc.

So if you plead not guilty you will be given a trial date, and most courts in NYS you at least have to see the court clerk in person to get the ticket tossed, I can't see a phone rep. locating your summons and taking care of it by phone and showing proof of the correct documents for his car.

What section of the law did you break on the ticket, they may have ticket you for a public display.

Also if you plead my mail make sure you check the box for a written Deposition, if its not mailed in the legal amount of time before the trial date the ticket also gets tossed, but it can be refilled by the prosecutor if they really want to nail you.

That's not a government NYC or NYS link for the procedure.

It all depends what the court your dealing with allows.

In NYS big cities even as small as Buffalo and Rochester, you can't really fight tickets as they are rigged kangaroo courts, as the city courts use assigned referees for minor traffic offenses.

Its different in the suburbs though, where the court system is easily accessed to a real court clerk.

No need to bash the whole dept as a whole as u can't expect everyone to be a saint out of 30 thousand plus cops. Go to court and fight it on the basis of the car info being wrong. Also he was kind of douche baggy for writing over ur PBa although its not wat it used to be, it does still work and they are harder to obtain

It seems NY is not evolving unless it's to hinder our rights. What OP can do though is have a traffic attorney appear for him to dismiss the ticket or appear.

I wouldn't plead guilty and I would file a complaint... period.
