Actually, what I got was screwed. Diminished value was a few bucks...not the $1500 I lost. I consider it the cost of my education, which I try to pass on as best I can.

You didn't get beat by the insurance co.on diminished value you got beat by the dealer when you traded it in.

Diminished value is based on allot of things some of them are which parts were replaced,which were repaired,how many structure pieces got replaced and so on.

It doesn't matter what insurance co. you have diminished value is figured out by a odd formula they all go by,they look at the repair bill and it is calculated by that.

Definitely sue the guy if he was under the influence. That car looks totalled to me, but if for some reason it's not, sue him for the depreciation of the car plus for the pain in the ***. I'd get a new car for sure, that thing looks jacked up.

So sorry to see this! I can't imagine my baby getting crushed. Then again you can (and likely will) always buy another one

Not sure that would be worthy. You go to court at your own, get a lawyer, win the case and the kid's parents (Idiot's minor) end up not being able to afford the costs, file for bankruptcy protection. now what? You got to pay the lawyer...

Please correct me if I'm wrong but I believe one could sue insurance only in the event there is more than property damage involved.

It is honestly the worst feeling to see your brand new car that you worked to hard for smashed in like that by some punk kid that is speeding in a 35 mph zone.. I just had put the viynl on the car few days before and was going to install test pipes on Tuesday so much for that plan... Twin turbo time? Haha

sorry to hear about that. buy i feel your pain. had a little old lady hit mine in a mall parking lot. i hadn't even changed the oil yet it had about 2500 on it.

but nowhere near as bad as yours.... do you have gap insurance?

Hate to say but that car is definately repairable! There's a very good chance your insurance will pay to fix that, although, it would be smart to file a DV claim as others are saying and sell that thing shortly after its fixed.

My god this sucks... so sorry man. My guess is that it's very unlikely they total it. Most insurance companies won't total a car unless it's about 70% (or more) of the value of the car to repair it.

I dunno man... those unibodies are pretty easy to destroy... 3 wheels, full suspension, frame, rear, driveshaft (i'd assume), rear body (you know the trunk is all screwed up so new plastics and metal there), as well as what appears to be airbags if I am seeing it correctly which could mean new seats... that is getting awfully damn close. Also in when I had a small accident, I asked my insurance company about diminished value payment and they said they don't do that... I am sure that is standard response but it wasn't worth the fight.
