I think modify can be used in court to define replacement of said exhaust. To change a part or upgrade is to modify. They would have you just on the modify part. Now determining if the vehicle was in compliance with Federal law that they would need to test. But if they did indeed prove that the exhaust out of compliance you could be looking at a stack of fines. Sounds like the pig let you walk this time to check his law he may hit ya on the flip side.

This is correct. Sounds like he did you a favor.



Also couldn't help but laugh at the "federal law supersedes state law"...you can still be dealt with at a local level.
