Yea the thing that bothers me the most is that i finally got the car and already got hit with a thousand miles on it. I was babying it and following all the break in rules. As far as the cop goes she said we might be both at fault which pissed me off but i explained the whole situation and i have a feeling that shell report the other lady at fault

She lied to the cop and supposedly had witnesses, if anything i had witnesses. The cop claimed my witnesses were family and friends. I really hope the cop understood my side at least you can tell of how the impact was that she is at fault..

Looking at the picture, I got some good news for you - that's a plastic bumper cover that you can replace easily. The Body shop orders a new Bumper Cover, paints it white - and with the car being new, the paint should match perfectly - and then replace the existing one with the new one. It's so easy to remove, you can replace it yourself even. Two screws, one in each wheel well, then a few clips on top, and some screws on the bottom for the plastic cover and the nose is off...
Now, the trick is, making sure the police report is factual and accurate, and have them pay for it...

The photo doesn't look too bad, but you know it is there. To make it a little less noticeable have you tried to wax out the scuff marks? By doing this you might reduce the visibility anywhere form 40-60%.

Unfortunately with an uninsured driver the end result is that your insurance will be paying regardless... still she should have been getting some sort of ticket for not having valid insurance... if she is able to walk from that regardless of fault then the whole process is pretty messed up.

I really cannot tell if the bumper is dented etc. I would buy some fine liquid polishing compund and rub the scuffs out by hand. The pic looks like it would be an easy clean up?

What the cop thinks makes no difference whatsoever. He/she can only report on their observations and witness statements. What will matter to your insurance company is your report on the accident, and the other person's report. They'll then investigtate and determine who was at fault, but the only significance of that is whether they consider it to be a chargeable accident (if your fault - therefore maybe a rate increase) or a non-chargeable accident.
As to who pays in the end, you can sue her for your deductable or other expenses, but as to the actual loss, that's the insurance company's problem. They can sue her if they feel they have a case, but you don't even have to be involved. |

wow that sucks. i would have the bumper replaced and repainted. dont touch the damage until your insurance claims adjuster sees it and makes full estimate. then you can do watever you want.
i would go ahead and have a good bodyshop start the work right away, pay the deductible and have your insurance agent talk to the girl's insurance (If she doesnt have one, have her parent's insurance cover it, sue them if needed) for your deductible reimbursement. if you dont want to go through with the process i think you can get most of the scratches out with polish and re-form the bumper with PDR. the paint that chipped off can be fixed for pretty cheap at your dealer probably, using their mobile touchup contractor for used cars. anyway gl with the repairs. chin up. |

Yup, might have a chip or 2 on the edge but will look much better. After the adjuster looks at it and takes photos of it that's what I would do, I always dread getting parts repainted if I don't have to....Especially Pearl white as it can be a tough match sometimes.
