Got Screwed on the Deal....Items Now 4 Sale

I wouldn't post anything for sale just yet, that's just a heat of the moment reaction. Talk to some other dealers this weekend and see what you can figure out.

Wow... $1755 under invoice was a smokin' deal. Wonder who messed that up? Maybe they didn't add the Sport package when they accidentally gave that number or something. (hence the $2400, which is close to the invoice on sports?)

Sounds like when he called you back to offer you 700 difference (making it 1700 more than your original quote), he was dropping to invoice.

That sucks dude, sorry to hear it.

Apparently they DID make a mistake, but +$700 is still a screaming good deal no matter how you cut it, and better than VPP..

Whoa! You're right! That's deceptive. It says "included" at the lower price (without a separate price for the option) then, when you click it, it still says "included" without a separate price, but the total price for the car goes up.

Every other option has a price listed next to it. But the AT says, "included". Not nice.

True, it is still a deal. But I would still rather take the amount agreed upon than the $700. The mistake was on their end. They should deliver as it was mutual and signed upon.

My contract has a disclosure statement at the bottom that says "Subject to VPP Auth. and incentives @ time of Delivery Current Pricing (Vehicle subject to price increase). My salesman indicated that quarter to quarter price increases are not usually more than $250, so I signed the contract.

No flame intended but...if I read your quote from the contract correctly -i.e., "Vehicle subject to price increase" and you signed that contract then it seems like they're within their rights to increase the price. You might have negotiated a cap on any increase to protect yourself before signing, especially since you were ordering the vehicle for future delivery. A cautionary tale for others. Caveat emptor. That price is too good. Was the contract written in January, before the big Nissan price increase?

If you can establish the quote was based on current pricing (see AK's invoice sheet), you have legal recourse. If the number was on the old pre-increase prices, you probably don't. Your state's equivalent of a small claims court is one way to proceed, but if you make enough noise (and if you're completely right), the dealer might sacrifice his complete holdback this one time.

If you go to court, you'll be able to subpoena the old sales manager, and this would be another very uncomfortable moment for your dealer. If they threw him out in the early spring with this economy, there "no love lost".

But back to your case... The difference was $2400, then they moved your way by $700. Rather than throwing a tantrum, throw THEM a counteroffer. (Whatever you think is reasonable and fair to both parties.) You're still in the midst of a negotiation, but this post makes it sound like you stormed off to the locker room.

Get all your facts together, chill, and call them back with a good-faith offer of... maybe $400. (Half as much as you want to go.) Explain that the court thing will take hours of your time you'd prefer to avoid, but you believe you're in your rights, etc. etc., you're losing thousands on the aftermarket buys, they had use of your $2K for 4 months interest free, blah blah.

Then let them stew ... and see if they come over halfway. At this point, you're going to settle midway between your "good faith" number, and their "final offer". If not, start a court action and serve them notice. (80-90% of civil actions are resolved before they ever get before a judge, but this shows you mean business.)

BTW, this is ALL part of the deal. Enjoy it -- perfect your technique.

i can tell from his picture and his location that it is fred martin nissan.

i actually bought my frontier from there a couple years ago, and was planning on buying a Z there. then i decided to buy a motorcycle instead. i didn't really have a bad experience there, but many of the salesmen are the stereotypical arrogant salesman who will talk out their *** to make a sale. i pulled up once with a buddy to show him the new Z, and there were 5 salesmen standing around outside. we parked and they were all staring at us, ready to give us their sales pitch. we pulled right back out to avoid having to deal with these vultures, and the one guy like walked after the car yelling something.

i would kind of rather buy a car elsewhere anyways.

plus their commercials suck.

Yeah I dont know how much you argued this before you stormed off.... sounds to me like you were really excited about the car and the deal..then the dream fell apart and you were so close that you got really angry. Then you posted your parts for sale out of anger...

Sleep on it man, tomorrow is a new day and a new chance to get your Z.

In the end, you know you still want the car. There's no denying that. You got all the parts already. Get it... install parts and drive it hard for some relief!
