You think I need to check out a NEW car more? I mean, it was NEW. It had small issues I knew of, that they took care of... but more that arose... and then more leading to this. It's just not acceptable.

It was sold as NEW - LEFTOVER. That does not mean major damage is acceptable. (without being informed of it).

yah, from my actual experience on another car i bought in the past, i learned that it is normal for dealers to repair cars and sell it new. like i said, i dont agree with their practice, but dealers do it all the time and i bet most people dont even know they are driving 'new' repaired cars.

and repetitive dealer visits for repairs, at least in my area, is opportunity to lemon the car and get a replacement.

Man that's a shady way to run a business

I did get a lot off.. and for good reason. It was a 2009 ... 2011s were on their way in a few months, and had miles, etc. But not worth this other damage and not worth it never really being up to par. There are many many more details that I'm not really going into.

Yes, kenchan is right. You're buying a product and inspecting it is your job. It doesn't matter if it's a pair of jeans or a car. If you're laying down $35k for something take a little time to inspect it well. Sorry about your situation, I really am. This isn't rocket science though...

Yah, its like selling a car with 80miles on the odo and calling it new. Dealers do it all the time. I don't like their way either. This is why I am very careful looking over the car before purchase.

Just cause the side was repainted it doesn't mean it was replaced some A'hole could have walked thru the parking lot and keyed the whole side.

Dealer's that have body shops usually give the new car salesman the est. and lets say it is $825 the new car manager knows that he will have to tell the cust. so the body shop discounts the price on paper to meet the $500 threshold.

Just a thought:tiphat:

This is definitely more than $500. Thanks though.

Happens more than you think.
Remember most cars are transported in open trailers so they get hit with a lot of things along the way, damaged when being unloaded, test drives.

Review: Dishonorable experience at Gwinnett Place Certified GTR Dealer, Duluth GA - NAGTROC - The Nissan GT-R Owners Club

it's a long story, but worth the reading. A win for pissed off consumers everywhere

I'll read in a bit, thanks.

I bought it from Woodbury Nissan in Woodbury, NJ.

its actually legal for dealers to sell framed damaged vehicles without disclosing it..

typically what can happen is that the car got scratched up on the truck or "fell" off. or a manager who demoed it crashed it.

dealers to dealers have to disclose frame damage, dealers to customers no.

NAAA (National Auto Auction Association) considers any replaced fenders or quarter panels frame damage...

sorry to hear that.

Actually... you are wrong. That is very far from legal. Different laws in different states though. But that is not legal in NJ.

msb3079 06-04-2012 12:29 PM

Hey guys...

Kept forgetting to give updates.

Nissan ended up only paying a payment as a "kind gesture" since it was a dealer issue (which is was). They did however contact the dealer and start things there.
I went to the dealer about a month ago.. and after about 2 hours of talking/explaining/negotiating... they agreed to do what I asked.

They took my 2009 370Z, which I owed $27,000 on. And they "gave" me a 2012 370 Touring Sport 6MT. Basically everything that my 2009 had. There were no Montery Blues anywhere around... so I ended up going with Gun Metallic.

They basically swapped out my loans. They took care of my 2009 and sold me the 2012 (MSRP $42,900) for $25,000 plus taxes and whichever.. which equaled to exactly what I owed on my 2009.

I could have gotten more out of going to a lawyer like many suggested... but as I told the dealer, I figured this would be the easiest solution for all involved. They eventually agreed. The entire process was pretty painless... just waiting for the the from out of state.

Everyone actually treated me very well. Glad it's over.

Jasonle 06-04-2012 12:32 PM

Glad it worked out for you man!

Ubetit 06-04-2012 12:33 PM

Sounds like a very fair offer to me.

gbrettin 06-04-2012 12:45 PM

I think the main thing was that they took care of the issue by doing what was right. I'm glad to hear it worked out.

Yeah, exactly. I agree.

Thanks guys.

MattP725 06-04-2012 01:19 PM

I'm not even sure you could have gotten more from a lawyer... sounds like you made out like a bandit. You have positive equity in a brand new car which is nearly impossible.

Montery blue is no longer offered hence why you couldn't find it.

Glad to hear they worked it out.

slo 06-04-2012 01:50 PM

Wow, at least it all worked out in the end. Sucks you had to go through all the frustration but it worked out.

Can you post your old VIN #? This way many forum members can avoid that car. Congrats on the new car. Hope this one is a keeper.

dmhenderson 06-04-2012 03:28 PM

This story is ...disconcerting at best. You were nicer about the situation than I would have been (but looks like it worked out for you in the end).

Ahhh... good point. I didn't even think of that! I will try to find it.

I've been in Sales and Customer Service type positions since I've worked. Being too pissed off and crazy doesn't always get the job done. You have to find a happy medium.

May be the reason he got the result that he did instead of the dealer digging in his heels....

twinturbonet 06-04-2012 04:17 PM

Drex 06-04-2012 06:09 PM

wow, good to hear to worked out in the end.

i bought a 96 altima years back from a body shop (red flag right there haha). they were selling the car since they took the title as payment for repairs on the car. the previous owner spent the insurance check before the car was repaired, and couldn't pay for the car when it was time to pick it up.

the body shop was owned by a family friend, so i took them at their word when they said it was only a minor accident where the car was rear ended (only cosmetic damage). when i eventually sold the car to carmax a few years later, they wanted to know about the major accident the car was in since there was obvious frame damage, and they could tell where the clamps were put when the frame was bent back into shape. :icon14:

needless to say, no one in my family takes our cars to that body shop anymore.

lesson learned.

MacLean 06-04-2012 08:13 PM

WOW....... I am sorry to hear that your '09 was F'ed up, but for the most part after all the BS you came out like an EFFEN CHAMP. You have a new nice looking car, color & assuming no BS with the new 370Z. You already have a lot of equity in the new car since you did make out like a bandit.

DYNAZOR 06-04-2012 11:51 PM

Looks like the dealer already has your car up for resale. I think your VIN was JN1AZ44E39M404734. Here's the carfax info., it seems to match your story.

msb3079 06-05-2012 09:25 AM

WOW! Good work! That is without a doubt, the car. That's my purchase date and mileage.
Sooo... that is saying "no accident/damage"?? WOW.

So how does the new Z handle/feel? Was it all in your head? Does the new Z feel like you expected? :driving:

I would try to contact Car Fax & dispute the claim, so no one else gets stuck with that lemon.

Glad you got taken care of in the end.

So shady! I just went out to my Z to review the vins! Can't seem to find the vin stickers on the rear bumper and rear quarter panels.... Any one know the location of these?? I did buy my 2012 370 new but it was a dealer transfer. Just want to make sure after this story...

Well it was proven that there were major repairs. But YES... it drives much better than the last one ever did. The last one never seemed to really be in balance (even when confirmed to be). It just always seemed to drive whacky.

The new one does drive MUCH better.

Mine was a leftover, demo with some miles... but sold as new, with no reported damage.

Oh, here is a picture of my new one... from a distance... sorry.

That is the downside to a uni-body, once it's be wrecked, it will never be the same.

Vbp6US 06-06-2012 01:45 AM

Wow what a great outcome. I say this but I know you went through a lot in the repair stage. I just got done taking my car back and forth for the ECM, slave cylinder, master cylinder, and hard pipe. All got replaced and my car sounds and feels good again.
