and repetitive dealer visits for repairs, at least in my area, is opportunity to lemon the car and get a replacement. |
Man that's a shady way to run a business

Remember most cars are transported in open trailers so they get hit with a lot of things along the way, damaged when being unloaded, test drives. |

I bought it from Woodbury Nissan in Woodbury, NJ. |
its actually legal for dealers to sell framed damaged vehicles without disclosing it..
typically what can happen is that the car got scratched up on the truck or "fell" off. or a manager who demoed it crashed it. dealers to dealers have to disclose frame damage, dealers to customers no. NAAA (National Auto Auction Association) considers any replaced fenders or quarter panels frame damage... sorry to hear that. |

Hey guys...
Kept forgetting to give updates. Nissan ended up only paying a payment as a "kind gesture" since it was a dealer issue (which is was). They did however contact the dealer and start things there. I went to the dealer about a month ago.. and after about 2 hours of talking/explaining/negotiating... they agreed to do what I asked. They took my 2009 370Z, which I owed $27,000 on. And they "gave" me a 2012 370 Touring Sport 6MT. Basically everything that my 2009 had. There were no Montery Blues anywhere around... so I ended up going with Gun Metallic. They basically swapped out my loans. They took care of my 2009 and sold me the 2012 (MSRP $42,900) for $25,000 plus taxes and whichever.. which equaled to exactly what I owed on my 2009. I could have gotten more out of going to a lawyer like many suggested... but as I told the dealer, I figured this would be the easiest solution for all involved. They eventually agreed. The entire process was pretty painless... just waiting for the the from out of state. Everyone actually treated me very well. Glad it's over. |
Glad it worked out for you man!
|
Sounds like a very fair offer to me.
|
I think the main thing was that they took care of the issue by doing what was right. I'm glad to hear it worked out.

Thanks guys. |
I'm not even sure you could have gotten more from a lawyer... sounds like you made out like a bandit. You have positive equity in a brand new car which is nearly impossible.
Montery blue is no longer offered hence why you couldn't find it. Glad to hear they worked it out. |
Wow, at least it all worked out in the end. Sucks you had to go through all the frustration but it worked out.

Can you post your old VIN #? This way many forum members can avoid that car. Congrats on the new car. Hope this one is a keeper.

This story is ...disconcerting at best. You were nicer about the situation than I would have been (but looks like it worked out for you in the end).

Glad it worked out...

wow, good to hear to worked out in the end.
i bought a 96 altima years back from a body shop (red flag right there haha). they were selling the car since they took the title as payment for repairs on the car. the previous owner spent the insurance check before the car was repaired, and couldn't pay for the car when it was time to pick it up. the body shop was owned by a family friend, so i took them at their word when they said it was only a minor accident where the car was rear ended (only cosmetic damage). when i eventually sold the car to carmax a few years later, they wanted to know about the major accident the car was in since there was obvious frame damage, and they could tell where the clamps were put when the frame was bent back into shape. :icon14: needless to say, no one in my family takes our cars to that body shop anymore. lesson learned. |
WOW....... I am sorry to hear that your '09 was F'ed up, but for the most part after all the BS you came out like an EFFEN CHAMP. You have a new nice looking car, color & assuming no BS with the new 370Z. You already have a lot of equity in the new car since you did make out like a bandit.

Looks like the dealer already has your car up for resale. I think your VIN was JN1AZ44E39M404734. Here's the carfax info., it seems to match your story.

WOW! Good work! That is without a doubt, the car. That's my purchase date and mileage.
Sooo... that is saying "no accident/damage"?? WOW. Quote:

So how does the new Z handle/feel? Was it all in your head? Does the new Z feel like you expected? :driving:

Glad you got taken care of in the end. |
So shady! I just went out to my Z to review the vins! Can't seem to find the vin stickers on the rear bumper and rear quarter panels.... Any one know the location of these?? I did buy my 2012 370 new but it was a dealer transfer. Just want to make sure after this story...

That is the downside to a uni-body, once it's be wrecked, it will never be the same. |
Wow what a great outcome. I say this but I know you went through a lot in the repair stage. I just got done taking my car back and forth for the ECM, slave cylinder, master cylinder, and hard pipe. All got replaced and my car sounds and feels good again.
