The police will only document your complaint but will do nothing. You will probably have to work with the tow company to fix whatever was damaged and you would have the burden of proof. You'd have to civilly sue the tow company for the repairs that was done. try Judge Judy.

Don't call 911, that's for emergencies. Look in a phone book or on the internet and you'll find their phone number.

You can call the police but probably won't accomplish anything...no crime has been committed. And if you were parked in a marked fire lane, knowlingly get towed, and report it stolen, you could be charged with false reporting. They didn't steal your car, you're the one that broke the law.

This is a civil matter. You're at a disadvantage because this probably has never happened to you before but the towing company deals with this on a regular basis. If you can prove damage occurred during the towing (cell phone photos, video, or witnesses), then you can take them to court. You can hire a lawyer to do that, but it will be expensive to do so. If the damage estimate is below your local max amount for small claims court, you can do that too and the only money you're out is the filing fee and the towing company has to pay that if the judge finds them negligent. But as I said, this is not the first time they've dealt with this so if you do go to court you'd better have your case really nailed down with photos, timeline, witnesses---a well-organized and well-presented case. You will have to prove that they damaged your car. If you can't do so in a logical, rational manner, the towing company will eat your lunch in court.

However, maybe the towing company is a stand-up company. Maybe the owner will recognize and acknowledge that the driver screwed up in towing your car improperly and will negotiate reimbursement with you. So don't go in to them with guns blazing, be calm and cooperative. Take your photos, and damage estimate to him along with a recap of what happened and tell them you need to file a claim because the driver towed your car wrong and damaged it. Don't get all pissy with them for towing the car because they were just doing their job. The fact that they did it badly is the nature your claim.

op- since you witnessed your car getting towed, hope you took a vid or pict. that way you can prove to your insurance co that they did not use a flatbed and damaged the car. that's wat camera's are for on your phones. to take witness shots.

Yeah i took mutiple shots before the car got towed. I took pic of front and rear and in the rear pic it clearly shows that the car is lifted and is not a flat bed. Only thing i regret is not taking the pic of the mileage...

Good question. I've heard of many people doing this.

The other day there was someone parked in the firelane at my local Publix. I went to walk around them and they must of came off the brake rolling forward. I said damn. They looked at me like they had no clue what to say. Say sorry you idiot. Guess they have the self entitlement disease.

he wouldnt need to video what truck picked up the car. Everytime a car is towed the driver, and vehicle number (truck number) is documented. So it shouldnt be hard to be like hey truck 599. ok what is 599. hey thats a pick up truck with a chain behind it. (example of course)

Might depend on local laws regarding fire lanes. Was it on private property (shopping center, residential community, etc) or a public street? Was there an emergency that required your vehicle to be moved ASAP?

Why did you decide to park in a fire lane anyway? Seems like you're the problem here, but I don't wish you any damage to your vehicle.

So you want to call the police and file a claim with your insurence company because you were illegally parked? It's a fire lane for a reason and theres a parking lot for a reason. If you stop in the fire lane and you are sitting in the car with the engine running, i dont see a problem with that. I do that all the time as my gf is coming out the doors of the mall and only once i had to move as i seen a fire truck coming. But if you parked your car there and went into the store, then you got what you deserved.
