sorry but crap like that is why i'm paying through the roof for insurance. if something happened, you just bill insurance for any property damage or physical injuries, and NOTHING ELSE. People like to be smarta$$es and "make friends" with lawyers and chiros and physicians and physiotherapists, and think they'll stick it to the big bad evil insurance companies. Well guess what, insurance companies aren't there to lose money. So as a result of all those bogus claims they have to pay, they end up raising premiums for everyone to recover the costs of being "skewered".

Boy did I get the phone calls later when he found out about the revocation. The court wouldn't give him his license back until he paid me and I signed off.

That's what I did the last time a bitch hit one of my cars. $1700 in the pocket, and $20 in wax/microfiber later, and a push-fastener, and it was G2G as far as I was concerned.

You pay insurance. Why not get some of your money back? Since you have insurance, what happened her company's fault. Your insurance payment allows you to claim against her company, the way I see it. Do it.

As she was at fault, I'm not sure how the law dictates in California, but only her policy should be effected by the occurrence. Therefore I'd go ahead and collect what you're owed.

OP depending on how bad it is, you might want to consider taking the cash. i got the smallest nick on my rear fender from a lady that slowly backed into me in a parking lot. I got a quote for $1400 and she paid me in cold hard cash! just buffed it out when i got home and you can barely notice it now lol

Just have a body shop fix it and have her pay the cash. No point in going through insurance since it doesn't seem the damage is enough to exceed the deductible.
