For $45000 they should total the car and buy you a new one.

Esfourteen,
Did you file this claim immediately after your accident? It's been about a month since i was rear ended so i'm assuming it's probably to late for me.

Also, any word on your 40th anniv emblem on the bumper?

I didn't file the claim until the car was fully repaired and back in my hands, about 5 weeks after the accident. (still no word on the emblem, going to call them this week)

Yup..You formally do it after the car is repaired. They can't do a fair appraisal until after it is fixed as there are several types of diminished value.

Ive' been told different time frames in which to file a claim. but everyone is right the car needs to be fixed before an adjuster will come out.

I did read somewhere today if you catch em in a good mood and depending on the age and mileage of your car sometimes you can get as much as 10% of retail. I did a kelly bluebook on mine today perfect shape trade in said 28,000.
but if i told them it was in a fender bender no way dealer gives me that.

so these claims can come in handy at trade in time.

I basically got 10% of the cars MSRP, just happened to work out that way I suppose. They didn't even want to look at the car, perhaps because it was so new. I did have to sign something that said I wouldn't come after them for any more money involving this incident.

I have to say if they offer 10% of msrp that works for me.
which would be around 3400.00
the rub is to put that money back knowing you will take a hit at trade in time
or do you use it on upgrades for your car. which at trade won't increase the cars value.
