Do not hire a lawyer unless you want to piss away 30-40% of the diminished value award. There are tons of these guys on the internet trolling for business. File a formal claim with the Guilty parties Ins. co. Good companies have dedicated reps that handle this stuff. BTW, I think you made a big mistake not calling the police...It's now your word against hers, despite the pics. Been there, done that. Allstate, the company that represented the girl that hit the guy behind me who then hit me was a little pissy about "Fault" until they found out there was a Video of the accident that the Police had viewed. Hopefully it all works out.. Last edited by Modshack; 05-12-2010 at 12:20 PM. |

Ive already made a claim with my insurance company to go after hers for the damage. My insurance company said i would have to call her company up myself and make the diminished value claim. So i will be doing that today

I would definitely go after DV. The fact of the matter is this. Years from now, when you decide you want to sell your car or trade it in, it is going to show up on a CarFax report that this damage happened. No matter how good the repair is, the fact that the damage is on a report will automatically lower your car's value. That's just the way it is. And this is what DV is meant to address / compensate you for.

No!
Her insurance company is responsible for your damages and loss of value. What company is this? My experience was with Allstate and it was relatively painless.. |

Her insurance is Metropolitan Life. I am going to address this today, I have heard so many different ways to approach this, but forget about a lawyer, i will be demanding a claim for loss of value.

a lawyer?..typically lawyers will take on BI claims...property damage however may be something that lawyers will not really be interested in...unless its a situation where the PD coverage of the B party has been exhausted..
