If it started happening again after 18k miles, I wouldn't call it a lemon. Just a mechanical issue that can STILL be resolved under warranty.

Well for one, I'd need to replicate it in order for the dealership to record it. I couldn't make it happen again, so there was no reason to take it to the dealership.

I had this exact same thing happen not too long ago at about 1500 miles. I have an MT, but your description sounds exactly like what mine did. Stopped in a parking lot, shut the car down, re-started and all was O.K. There were no warning on the display, etc.

I took it to the dealer and described what it was doing. They hooked it up to the computer and found no codes or anything else to help them diagnose the problem. Intermittent problems that don't throw a code will be difficult to find because basically you have to drive it to the dealer while the problem is occurring. I'm not sure I could have gotten it there.

You guys must all be running MAC's and never experienced the Blue Screen of death. A Re-boot usually fixes the glitch..

But since you took it to the dealer its in their system so if it becomes a problem you already have it documented and it can be used if you had to declare a lemon. Thats all Im saying, get it on record just in case.

Its kinda like medical, the more thats documented the better it is later on for disability.

true but what if its more like every couple thousand miles of hundred miles? I get everything looked at at the dealer when I take it in, even if I cant replicate it on the spot, its on the record. Whats that old saying? " an once of......."

I think this is the difference between some companies as to what thier repair problems are compared to other companies. People that own BMWs and Mercedes, etc. tend to take the car in for everything, big or small, and this makes their repair reports look bigger. While other people that own other brands tend to let things slide or fix it themselves and it doesnt get reported on the companies reports so they look like they are doing better than others, when they may not be.

When I go in to get my rims fixed that the dealership messed up when they put on new tires Im also going to have them run down a couple of squeaks that I hear and look at one of my brakes that is making a groove when the others are smooth. Let them deal with the sh!t. But to each his own.

This is true, they absolutely do! You can check any BMW forum and you will see just that!

OK... I drove it to my office, from my office to a meeting and then back to my office with no problems. Driving home from my office is when it started again.

I think it has something to do with the auto transmission.... It almost feels like it is prematurely switching to a higher gear (no power at low speeds) and then switching back to a lower gear (causing the car to buck and shake.) It didn't get to the point of not being able to move this time because I pulled over and restarted it once I felt it happening. Even then it still felt wrong.

There is definitely something wrong.... I'm bringing it in first thing tomorrow for service. Is there a grace period where you can return the car for a full refund? Anyone have any experience with this?

Sorry to hear, it's best to take it in now. The lemon law pretty much states that if the problem can not be fixed in a reasonable amount of attempts it can be deemed a lemon. I think a "reasonable" amount is 4 or 5 times in 2 years...something like that.

New York Lemon Law Statutes

You should be able to find everything there. As far as straight up returning the car, I guess it depends on the dealership. I would think most would rather try repairing it and later on declare it as a lemon.
