By ESP do you mean VDC?

I"ve had rear wheels break loose with traction control on, not for long because traction control will catch up, but i think its possible. if you're accelerating hard and hit a dip in the road you can lose control also.

It's true that they can break loose, but technically traction control can never be disabled without modifying the map or supposedly pulling a fuse. Might need to hunt down some threads.

Have an on-board camera in the car focused on the HUD. The traction control light should effectively blink both when VDC is on and off when you attempt to break traction.

You can spin the wheels for a half second or less with it on, but as soon as it detects that the wheels are spinning it immediately cuts the throttle allowing for the wheels to stop spinning. It can also apply brakes to all or individual wheels as needed.

What it cannot do is break the laws of physics, if your going too fast and hit the gas in a turn and break the rear end lose and start spinning, losing almost all traction, it won't magically get control of the car again.

If you did a 60m burn out, it was not working or was turned off (VDC OFF light should have been on during your burn out).

Edit: Oh and VCD has turned itself off with out me realizing, on the track I had worn the brake pads down enough so that the brake fluid got low enough (50%) to turn off VDC.

It will spin. The problem is when it get's really bad it will apply a rear brake for one of the sides to help control it. It is very harsh and will cause you to go the opposite direction. So, if you are counter steering you will have to quickly counter steer the other way. It has happened to me. Freaked me out at the moment.

I have a 2016 sport model 6 speed. I don't have too much tread left on my rear tires right now so it's pretty easy to spin the tires and my vdc light comes on all the time when I'm barely pressing the throttle. Back when the tires were newer I only had the traction control light come on when it sensed the tires spinning but now I get both lights and the vdc light will stay on until I restart the car. So I'm wondering what kinda shape your rear tires are in as this may have played a roll in you experiencing excessive wheel spin. I'm thinking that maybe your tires are getting bald, and when you broke traction at the top of 2nd gear and the vdc system turned itself off like mine does and wasn't able to correct the wheel spin which caused you to lose control.

Maybe someone else can chime in on this because I'm not sure if this is a common issue. It could just be my particular car...

Also, 50mph in second gear is pretty high in the rpms. From what I've put together about your accident, it sounds like you may have been driving aggressively and simply lost control of your car.

Also, in agreement with another statement made earlier. even IF ESP/VDC somehow turned itself off, it's never fully off nor is stability control unless you've really ****** around with the electrical system

I remember reading somewhere on here someone was in the rain taking a corner on a bridge.the metal spacers caused it to slip a bit and then the traction control went into overdrive locked the wheels and he ended into the guard rail

I have been in your country numerous times, on business and vacation.
I honestly suggest that you do yourself, and your family, a big favour and hire a competent lawyer, preferably someone that is not a family member. Although you may not be at fault, you have to prove beyond a reasonable doubt that this was either a engineering issue, a technical malfunction or a road issue (i.e. black ice, oily roadway, debris, etc.) that caused this disaster. I would also remove any videos from youtube that showcase your preference for excessive speeds on public roads or racing. This type of video footage will work against you in a court of law. This is the best advice. Also read the description of the VDC in your manual. It will tell you how it works.
