Get a lawyer, if they don't have insurance then you can get pretty screwed. Definitely consult a lawyer.

Since it's a company that is liable for this, I would think that a lawyer would have no problem recovering 100% of the costs to repair the car to new condition. It's really just up to you as too how you want to handle it. Consult your insurance company and see what they tell you. They will likely make recommendations to you or at least spell out your options. As I see it, you have the coverage so you can let your insurance company sue them or you can sue them and not file a claim with your insurance. The only benefit I can see of you suing them is to avoid increased premiums. If your insurance isn't going to jack your rates on this, I'd let them do the suing. A similar situation happened to me recently but the other driver was insured. My insurance company sued them since they were cited as being 100% liable for the accident. They recovered 100% of the cost to repair, including deductible, and rates remained the same.

It depends on your insurance you need to ask them. As long as you have police report stating you are not at fault then your premium will not go up. If they don't want to pay cash to fix your car, then file a claim thats what insurance for.

Personally I've parked this car in the garage and not moving it at all. But as of to the frame being damage, I want to get it appraised because my car is not squeaking when I turn so it might be alignment / suspension or the frame bring bent. NO idea as of now til maybe monday.

Wow, I can't recall how many of my friends got screwed by uninsured drivers in SoCal. Believe it or not, a similar event happened to one of my friend's girlfriend. A car backed into her Mini at a uphill stoplight and floored away, unfortunately she was in such a shock at the moment that she just couldn't recall the plates numbers or even the model of the truck. Luckily, a witness was able to provide statements and the driver ended up being an undocumented citizen.

Sorry to hear this, too many Z's getting banged up. Fortunately, the damage look minor and should be an easy fix. It just sucks being in any accident but it feels a bit worse when the car is brand new.
