Update on MY high pitch noise.
Before this turns into a thread about a fuel pump or the noise above the engine when you turn it off. So please don't make this a thread about the noise. I have had people PM me asking for an updater so I am posting an update.
I hired an attorney about 2 months ago to go after Nissan and the high pitch noise and the attorney contacted me today with an update. Nissan offered me a settlement (amount will not be disclosed), but I have to keep the car. It was basically a go away offer. My attorney told me that at no time has Nissan denied the problem, they are just trying to downplay it as an minor annoyance. I asked him what I should do and he told me to take it to court so I said ok. I do not want a settlement and this not about money, this is about Nissan not willing to fix a problem and because of this I want the car gone. I brought this noise up to my dealer within the first hundred miles of having it and I feel Nissan should have just switch out the car then. I am posting this because more people need to not just say 'well I love the car so I'll put up with it'. IF YOU HAVE A PROBLEM TAKE IT TO YOUR DEALER AND FIGHT! All of you whose hatch doesn't open FIGHT, don't just take it because you like the car. The more people that complain the more will get done. |

im curious though why some have this issue and others dont... and if nissan knows what the issue is then why dont they just replace the ecu to see if the noise goes away...

One member here had his ECU replaced but the problem was still there. From my understandings from the Nissan tech is that they would almost have to rewire the entire car to find the problem. There seems to be no correlation between build dates or vin numbers.

Minor annoyance. Whatever Nissan. I've gone over to the Infiniti FX forum and asked if anyone has this problem. My '09 FX doesn't have the problem, and it sounds like noone else does either.
What was interesting was someone had an EX35 loaner and heard it loud and clear. This was before knowing this was ever an issue. Roo, did you ask to swap cars, or ask for your full purchase price back? I would think they'd say if you wanted a swap, they'd just say to keep your car with a cash reward. If you asked for full purchase price back, they'd just do it. I can't stand this noise and don't think of it as "minor." Nissan, if you're reading, FIX THIS FAST. I'll be sure to take my sister's EX35 in as well. My FX, I'm not taking it in (nor will report it) unless I can hear it... which I can't. That just shows you that I'm not just scratching for a complaint. Good luck Roo. Nissan said they're working on it, so I'm not going to sit and fight. I'll wait for a little while. I still trust them. I know, Roo, you've had it. Did anyone say that they are working on the fix for you? (Roo, I've asked you two questions in this thread.) Thanks man. |

I say take the money then someone else start a sue job. Your lawyer will of course say go to court if you are paying him by the hour. Or is it I get paid when you do? Then that might be good.

When I first brought it to my dealer they tried to tell me that noise was normal and nothing was wrong. I asked them to drive another car on the lot and they said ok, the noise was not there. I asked them at that time if I could swap cars but they said no, but again I went through my dealer when I should have called Nissan. At this point I am going for a complete buy back, I am not interested in keeping this car with all the problems that have arised. Something else that pisses me is the latch sticking. It really sucks to go to your car in the pouring rain after leaving the grocery store and you have to put your groceries on the wet floor so you can use both hands to open your hatch. And now your bags are all wet, things spilled out etc etc. It's even worse when you come out of the dry cleaners. Nissan told you they are working it? I have not heard that, but then again Nissan cannot contact me after I hired an attorney. Last I was told is that there was no fix at this time. I believe I answered both your questions. |

Roo,
thanks for the detail as I wondered about your case. Btw, my understanding was that the Manager at 1000 Nissan had to fight for my new engine. At least that was told to me. I agree with your route. Go for a full buyback. I read about the California law---do you have to go to arbitration first? |

But to answer your question I do not know about arbitration. I do know that you can get around the arbitration but I am not an attorney and I'm not interested in that. I do not want damages I just want the car gone. |

Dealers have to go through a lot when there is a major component swap such as an engine or transmission. They don't really have to fight per se, but they do have to prove that there is evidence that it was an equipment failure and not abuse.

Roo...if your's is as loud as mine, what you need to figure out is a way to measure the DB level of that sound to prove it could cause hearing damage. That would be the game changer. The guys on the G37 website have taken the first step towards identifying the frequency, now what we all need to do is get equipment that can accurately measure the sound level at that frequency. We at least need to prove that the noise is loud enough to cause a distraction which would make the car unsafe to drive. That would also be a game changer in getting a fix. |

And like I have said in many threads, HIRE AN ATTORNEY! Even if Nissan comes out with a fix you will be compensated. |

Thanks for the updates Roo. I was going to purchase my 370Z soon, but now will hold off until there is a fix since some of the 370Z's started with the high pitched noise after like 8000 miles. So, even if I test drive a 370Z without the noise doesn't mean it won't start making that god awful sound down the line. SO IF YOU NISSAN TROLLS ARE LURKING AROUND, GET THAT PROBLEM FIXED SINCE LOTS OF YOUR CUSTOMERS READ THESE FORUMS BEFORE THEY BUY THE Z AND NOW LIKE ME, PROBABLY WON'T YET, AND YOU NEED SALES JUDGING BY THE DECREASING MONTH OVER MONTH Z FIGURES. Good luck Roo.

Problem is only the PROBLEMS get posted on boards like this. You will find most are heavily biased toward problems. People just don't jump on here and say, "I had a wonderful drive today. Nothing went wrong." every time they have a great or normal experience. Anecdotal evidence like you read on these forums do not, in and of themselves, prove anything. Folks just don't remember when things go right - but every boo-boo will go down in history to be quoted forever.
That said, as an engineer, one must investigate each one to determine whether it's indicative of a larger problem or not. So, by all means tell Nissan about your problems, but don't condemn them if they don't immediately issue a TSB based upon your complaint. And one other suggestion - Don't base your buying decisions on what you read in all these forums alone. You'll never buy anything. (Also note that 99% of 370Z owners don't even know these forums exist. ) |
