Yes. It's a known issue and there are threads about it.

Mine only does it when it's cold.

Yeah, I just read the thread. I saw that this was an issue in 2009 but it still exists. I'm gonna go to the dealership and see what they say.

Yes it's a known issue. I was just talking about this with other members on the forum.

Nismo wing or spoiler!? help!

Link below is helpful too but you got to have time read through everything.

!!For 370Z Owners with the Stuck Hatch Release Issue!!

I just fixed this problem a month ago. Nissan dealership should replace the spring for you for free. Or you can do the 2 penny trick which is easy enough too.

Thanks for the info and the links. It seems that my Nismo has the shorter one. I like the penny fix but am inclined to have the dealer fix this!

No, Nismo has the short ones too. But Nismo has the transparent rubber pieces to help the springs. The longer spring you saw in the pic is actually from 350z. And you are absolutely right, let the dealer fix it!

im jelous of the upgrades, and that black is amazing! had i not owned a black car and known how anal id have to be to keep it clean i would have went black.

Thanks! Black is a pain but it gets easier if you keep up with keeping it clean. It always seems worth it when I look at it after and it shines!
