Recaro seat-back won't hold position?

These Sportster CS aren’t specific to our car, they are available for purchase as aftermarket, and other manufactures (for sure BMW) offer them as option as well. Brief search doesn’t

Following up, Nissan North America didn't consider this seat problem to be a safety issue. They only checked on whether they would consider buying my whole car back which I obviously was not going to have them do. They refused to warranty it which I kind of expected.

Recaro checked with engineers in Japan and said the only way to fix the problem is to replace the seat back, as the mechanism itself is not serviceable. They said they cannot take parts or help with replacement as such because they are considered OEM parts. If it was a fully aftermarket Recaro seat it would be a different story.

So I am at the point where I will see if my extended warranty will cover it. It is bumper to bumper and covers OEM parts, so we will see. Crossing my fingers. Anyone else still running into this issue and/or found a solution?

I’m going to be sending them pics of the seat and a sticker on the bottom they need to see and they will get back to me. I will update if I hear anything. I am also starting a case with Nissan consumer affairs.
I have a set in my car and have no issues. They take 900whp quite well. I never have to adjust my seat back. Now my Recaro seats in my 1975 280zt I needed to adjust it back up from time to time. Those seats are older than dirt though.

New update, my extended warranty wants to help, but they don’t have a good way of verifying the problem without really driving the car (even though my Nissan tech verified it and I provided pics). They said they can’t help unless I can get paperwork from Nissan stating it’s some kind of TSB or multiple people have reported and logged the issue with Nissan.

Recaro said it isn’t serviceable and the entire seatback would need to be replaced. Not what I wanted to hear on either front given the lowest I’ve found a new seatback is $3,200.... I can’t believe it really costs Nissan that much so I’d love to know if anyone here has leads on new OEM parts.
