Need some Help with a Ticket
If this is in wrong section sorry mods.
So my mother got pulled over for speeding, and the cop told her not to worry about it and that he will give her a ticket with no points and its worth 85 dollars. My mother re-confirmed with the cop and asked if its no points and he assured her its no points. So my mom brings the ticket home, i look it up and the ticket is for failure to keep right...what does that even mean, well its a two point ticket. The ticket is 185 and its worth 2 points. Its not a speeding ticket but its still two points and my moms english is lacking so taking care of it. I would like to see if i can get the no points and just pay the ticket but im not too sure, ive never gotten a moving violation ticket so im really not sure. So what should I do in this situation, Im really not sure what to do here. As in would it better to eat the two points instead of argueing or if its better to see what my options are? |
i would take it to the village that issued the ticket and see wat they say.
the last ticket i got was over 10yrs ago so i could careless about minor points like that though. and 85 is cheap for a speeding ticket. |
Get a traffic lawyer involved, they can usually cut deals to keep points away from the equation.

Just to let you know, failure to keep right = driving on the left side of the road, aka fast lane aka passing lane. In NJ, the left lane is supposed to be for passing only I believe.

you can probably bring it down to an unsafe driving which means 0 points but its expensive and you can only do 2 unsafe drivings every 5 years...personal experience :shakes head:

Does she know that the left lane is for higher speed? I would contest the ticket in court. The judge has the authority to lower the ticket. I would not get a lawyer for something like this unless she has a CDL or something like that.

Cruising in the left lane is dangerous, annoying, and rude. It should be a traffic citation. I'd like to see more people get tickets for doing it. IMHO. Sorry

I think you missed the point MacCool, the cop pulled her over for doing like 5 over the speed limit. And gave her a different ticket.

So if she had a trash bag full of weed in the car and he pulled her over for speeding she should only get a ticket for the speeding? Is that your rationale?

A string of 8-10 vehicles pulled in behind the trooper in an effort to pass the vehicle in the right lane. The trooper pulled that entire queue over and ticketed each of them for driving in the left lane without passing. I don't know if any/all of those tickets were ever dismissed or not. It's a crazy world on the highway. |

She wasn't actually in the left lane.....the cop pulled her over for going over 5miles on the speed limit, Told her he would give her a pointless ticket worth 85 dollars but actually have her the failure to keep right one.

if you're worried about the points, take it to court. every time ive done so, the judge threw out the points and only made me pay the fine. ymmv

OP get a lawyer. They can save you from points 90 percent of the time (at least that's been my experience)

Don't know rules in NJ, but in CA you can go to traffic school, pay the ticket and traffic school fee and there are no points and insurance is not affected. Probably much cheaper than getting a lawyer...if in fact NJ has this option. Good luck

Just plead not guilty and then talk to the D.A. See if you can pay the fine with deferred 30-90 days then get it dismissed. All these folks want is your money so offer them the money with no point assessment if you can. DO NOT PLEAD NO CONTEST OR GUILTY WITH AN EXPLANATION. YOU WILL BE FOUND GUILTY AND CANNOT GET OUT OF THE CITATION.
