Default Should America use the "eye for an eye" justice system?

I know the old saying "an eye for an eye would leave the whole world blind". In my opinion though, I think it could prevent a lot of crimes. Some countries in the middle east use this. If you aren't familiar with it, here is how it works: You are caught stealing, you have a finger cut off. You stab someone 15 times, you get stabbed 15 times. You throw acid in someones face, you get acid thrown in your face.
I know it seems harsh, and I only think it would be fair if there was 100% proof and evidence that the person committed the crime, but I think it would make many people think twice before doing it. Could you imagine, having a finger cut clean off for stealing, rather than just a smack on the wrist or small fine? You would think loooong and hard about stealing.

Anyways, I am not saying I am all for it, was just curious what others think about it.

This would be the hardest part, being 100% sure.

Also there should be exceptions, if you come home and find your wife and best friend in bed and proceed beat the guy within an inch of his life, I don't think you should receive the same beating.

See what I mean, it's too subjective....nice in theory tho..

I agree jjaden, at some point there should be some exceptions to the rule, but the question would be what is the "some point". Maybe they could make it apply for certain crimes.

What about the ones who didn't commit the crime, but got pinned with it? Can't give them back an eye.

That is a primary point of what deems it wrong in certain situations. It would be terrible to falsely accuse and have the punishment.

Here is a scenario, lets say you walked outside and noticed your Z sitting on some cinder blocks. You catch the guy(s) a few days later, and HAVE your rims in the back of their van all scratched up. What kind of punishment would you want that thief to have? If it was me, I would say off with a finger for each of them just because I CANNOT STAND people who steal from others who work for what they have. It is probably one of my biggest pet peeves.
