Just got around to reading JB the Hutt's 'stay at home' order. He lied. Shocking for an Illinois governor; I know.
At the press conference announcing the order, he specifically said he asked, not ordered, Illinoisians to stay at home. The order, however, specifically commands us to not leave our homes except for the circumstances delineated in said order. I, and other attorneys I have spoken to, are of the legal opinion that this order violates the 1st and 14th Amendments to our Constitution. Forecast is a high of 59*F tomorrow. So, let’s say going out for a drive for pleasure isn’t allowed. How would that be enforced?
My assumption is po po still need probable cause to pull you over. If you don’t break any traffic law, how would po po even find out you are just taking a hobby drive vs that of a necessary one? |
