I am only trying to make a valid point about replicas. MOST OF THE AFTERMARKET PARTS out there are REPLICATED from OEM design HOWEVER made with CARBON FIBER which isnt offered by NISSAN. I simply found a company that offers a full carbon fiber body kit. NOBODY OFFERS THAT OPTION. So a company that developed this "replica" amuse kit is similar in theory to SEIBON MAKING CARBON FIBER OEM STYLE MIRROR CAPS, HOOD, HATCH, DOORS... the material is different but this is acceptable... SO Why is this situation being treated any different?

Im just tired of everybody jumping on this REPLICA bandwagon. AND A FINAL REMINDER, we dont SELL any body exterior parts so again, this thread is simply a visual update on my project.

WHEN IS IT OKAY TO REPLICATE? WHENEVER A MEMBER DECIDES ON ONE PRODUCT RATHER THAN SPEAKING YOUR MIND ON EVERY REPLICATED PART THAT COMES TO MARKET... You came into someone else's thread who was floating the idea of making carbon fiber parts and you, as a vendor, crashed her thread and basically berated her with talk down and condescending language. Not sure how much pity I can have for you when someone comes into your thread.

I understand your frustrations but your argument is weak and not even the exactly same circumstances that you are trying to express.

If I decide to change a few words to a book I liked reading for example, put my name on it and started selling it for a profit. The original author would rightfully be upset.

Arguing this stuff is childish. Everyone, including yourself, knows selling something counterfeit is wrong. People can justify and reason all they want... be it price, color, texture...whatever...it doesn't make it right. No one is attacking you for the great job you did on YOUR car. There's just no need to be defensive because someone called you out on your "replica" kit.

I'm simply trying to approach this as finding the distinction from a fine line. I am a graphic designer and have had people take my design and alter it just with different fonts or colors. It did make me mad but it happens and if they changed it enough, it becomes their own design. One thing I have learned as a designer, is that the best designs have been influenced by something they have seen someone else do. You just have to take it as a form of flattery I guess. Researching copyright laws, this website categorizes this as a moral rights.

I think it applies to all those parts, but that's not what I'm trying to get at.

It's basically up to the original author to decide what they will allow. Nissan doesn't seem to have an objection, for or against those parts, so we don't really know if it's okay or not. We can't really comment on it without Nissan's views. I was under the impression that they allow it, but with the caveat that Nissan is no longer liable for parts modified or replaced with non OEM part. They, like all manufacturers take copyright cases seriously and will usually let the small stuff pass without legal action. More extreme cases see a far more pronounced action.

Since the prospect of a near identical replica of the Powerhouse Amuse kit is in question, we can use that as an example. They, Powerhouse Amuse, don't want people buying or selling an exact clone of their product in ANY shape or material. Period! It's something they have clearly explained as a direct infringement of their intellectual property. If they were to go to court against these replica manufacturers, the result would be without a doubt in Powerhouse Amuses' favor. Just because you think it's expensive, it doesn't give you the right to copy that product. Call it whatever you want...influence, flattery, whatever....it's still plagiarism. Just because you refuse to take action at someone copying your work, it doesn't make it right. The right to give or deny permission to replicate and sell is rightfully & soley with the owner of the original design.

Understandable but listen, IM NOT SELLING PARTS lol... This is simply something I bought for my car. Amuse doesnt make a carbon fiber body kit, just like Nissan doesnt sell Carbon Fiber pillars, mirrors, dash etc...All I did was buy a carbon fiber body kit because AMUSE doesnt offer them in full carbon.

BTW why does he sell 2 different sets of mirror caps, dash pieces and etc? Somebody is replicating a replica if you ask me. But everything is a replica and yes its an amuse kit but the original source does not offer it in full cf so I purchased my stuff from a company that offered carbon fiber parts that I couldnt find anywhere else, just like seibon/VIS offer threw their entire product line... Honestly, if i wasnt so bored at work this week I wouldnt have been this involved

The issue isnt with Nissan, per 370ztune its the principal. BUT YET, he offers product that were developed using the same design/material ingredients to replica kit and existing part and offer it now in carbon fiber. CF pillars, mirrors, which is the same method that was implicated in a carbon fiber amuse kit being made available.
