Evo-R Rear Fog Light (Is the flashing while braking legal in the states)

Just recently purchased this fog light to replace the OEM reflector and am a bit concerned I'm going to draw unwanted attention from the law. Is it Legal?

Pretty sure I've seen cars do this to a degree from the factory. But I have the light as well, and have for over a year all up and down the east coast. You shouldn't have any issues

Mine only blinks 4 time fast, 3 times slow then solid brake light.
