is this csc failure ?

dealer just called back and said since its part of the master cyclinder it only 3 36 and not covered

At least the master cylinder is easy to DIY (if you want). The part is only $130 or so, and you should be able to do the replacement in under an hour easy. Good opportunity to put in your own brake fluid as well (Motul RBF600 is highly recommended).

I can fix by replacing the master?
The dealer (who hasnt seen the car yet)said its necc to r&r the trans to fix this and is 9hrs labour

If the CMC is the problem, the part is easy to replace. One hour of labor tops. The part is bolted to the firewall (and connected to the clutch pedal on the opposite side) just below the reservoir. The space is tight to work with, but you should be able to remove and replace the CMC without too much difficulty.

If the CSC is the problem, the part is very difficult to replace. I've usually seen 7-8 hours for labor, but 9 hours is not completely unreasonable. Also, if the CSC is being replaced, you should make sure they replace the CMC as well (regardless of whether it has failed - the internal seals in the CMC are likely already compromised by the dirty fluid from the CSC failure).
