Default Parking break failure

so last night I was lucky enough to catch my beautiful 370z rolling backwards down a hill towards oncoming traffic due to parking break failure.

I always put the car in the appropriate gear when parking on a hill an turning the car off. I was running across the street to use an atm an left the car on assuming the parking break wasnt garbage.

I herd a noise which caused me to turn around and see it rolling backwards. I ran an jumped in so quick that i caught it before it really got bad but the worst part is the front an back rim on that side have curbrash all around them just the very thin lip where the rim an tire meet.

The car is four weeks old bought it used with 30xxx. is this something even worthy of callin the **** dealership i bought it from over?

Honestly thinking about trying to get ahold of the bank to see if they have it on a security camera to show you guys

That sucks dude. I would absolutely call the dealership. I'm not sure they'll do anything for you (I wouldn't expect it but on the rare occasion they surprise even me). If you can get some security footage that shows the car stopped when you get out and then rolling away after something failed, you will probably have a better chance with them. If they cop an attitude or just flat refuse to help, I usually find it a little cathartic to curse them for being a typical dealer$hit. After that, I would probably call my insurance.

There is a thread around here somewhere for adjusting the parking brake. I would definitely check that out.

it wasnt a driver error i was worried about that but when you made you comment i realized the vid will show the car not moving for about fifteen seconds then out of no where that happened.

In most states it is illegal to leave a car running and walking away from them.

Excellent point. The term in the Texas Transportation Code is "unattended". I do not know if there is a definition for that. You might have an argument that you did not leave your vehicle unattended if you didn't walk too far from it.

*edit* I found records of police ticketing people at airports for an unattended vehicle when getting out to load luggage for a passenger they are picking up. I would never think to turn off my vehicle when doing that. How about tow truck drivers that leave their vehicle running for power while they winch a vehicle? Guess I'll have to be more mindful of this going forward.

I saw an episode of bait car where they parked it in front of some lady's driveway (fvcking idiots). She went out and stood around the car for a few minutes looking around for the owner. Finally she got in and moved the car a few feet so she could exit her own driveway in her own car. They pulled her over and interrogated her like a criminal. She was like I need to go pick up my kids from school and someone left their car running in front of my driveway, so I moved it out of the way. Thankfully they weren't complete a$$holes and apologized and sent her on her way. I can't say I would have been as polite as she was

I assumed most newer vehicles with Automatic Transmissions won't allow you to turn off the car in any gear other than N or P?

Unless my car is sitting in my garage I always put my M6 in gear with the emergency brake engaged. And if I am on a hill I angle my front tires to go into the curve in case the above fails.

Can you reproduce this?

I think the dealership could be liable for selling you an unsafe car. At the very least they should fix your transmission for no charge for something overlooked during a safety inspection.

People have been killed by vehicles jumping out of park. If you had even a sip of beer and your Z ran over a pedestrian I bet you would be sitting in jail right now eating green eggs and ham.

Yeah that's why i was worried i was coming back from the casino an wanted to deposit my winnings into my account through the ATM machine. It is a six speed that is why i had this problem. I always put it in first or reverse when i park but i just figured id leave the car running for a minute. honestly think its because when idling the shift knob vibrates pretty aggressively and maybe that had something to do with it no idea though

I'm not thinking it was transmission related. Try this: DIY: Fix your crappy Parking Brake...make it work!
