Lol, NY is a no fault state yes, hense you CAN'T sue...
At fault driver covers the collision, your insurance covers your medical. There's no sueing to be had, unless it goes over something like $50k in medical. You can't even collect diminished value in NY.
Not sure where you get the idea you can just sue someone for hitting your car, you can't unless they don't have insurance.
