If you do, sue. There is protection is place to make sure that this doesn't happen. A H1-B can only be issued for a skilled foreign worker if it can be proven that there is no one to take the job or that no one has the skills for the job. You have to run adds in major newspapers for several weeks advertising the position and requirements, you must receive zero qualified applicants.
