Yep, I have it on my motorcycle. Never had a cop say a word to me, even the few times I've been pulled over. I think it's less offensive on a motorcycle since the reason we get it to attract attention. You'd be surprised how many drivers don't know when a motorcycle's brake light is on. But most bikers who get this done also have that as extra, and still keep one primary brake light that doesn't flash. Most, not all - yeah I skipped it, but mine only flashes 5 times then stays solid, and decreases with each brake push within like 5 seconds.
I've seen cars with the brake light in the window flash, or light up sequentially (when consisting of a bar of LEDs) and I don't think those guys ran into any trouble either. As long are your primary brake lights (the ones on the back bumper area) are not doing anything funny I really do think you're okay. However, I imagine if you have an obnoxious, bright LED strobe effect going on, you might catch some grief. But as low as that fog light is located, I'm guessing cops won't care. Again, check with Johnny law if you have any concern. Come "quota time" no telling what you'll get...
