I think you need to disclose the shop in question and let them feel the entire wrath of the internet. You'd be surprised how cooperative these shops become when their reputation and business is on the line. Obviously, the right thing to do here would be for the shop to buy the car from you, plus compensation for your troubles. You break it, you buy it.

Yeah. Get a good lawyer and just sue for what's fair i.e. the MSRP for your car. I don't think it'll be difficult to get that to happen.
I hate aftermarket hipo shops in general. When I was into Hondas back in the late 90s, early 2000s...all those schmucks were so shady. They used to say things like, "If you do your swap with us, I'll throw in a new timing belt, water pump, etc. and install it for free." They never deliver on time. They overcharge for things they never install or perform. F'in total liars and crooks! |

OP should definitely sue rather than accept an insurance settlement, but it's highly unlikely he'll get more than actual damages. In the meantime, the lawyer will be expensive, assuming he can find one that will take the case.
Pain and suffering or other such "general damages" isn't generally a component of a property damage lawsuit. His ability to exact revenge is going to be pretty limited. Local or state statutes may actually favor the shop. Starting an internet campaign is definitely unwise before legal action is concluded. Last edited by MacCool; 08-21-2014 at 08:13 PM. |

FL is a "no fault" state, but if a police report indicates the shop (or the individual who was driving, anyway) is at fault, you can call your insurance, explain the details, and let them and the other insurance company fight it out.
If the car is totaled, when all is said and done, you should be getting a check cut to you from one of the insurance companies for a new car (however, the shop/driver should eat the deductible -- fight for that). If the car is not totaled, look into receiving additional compensation for diminished value from the shop or driver's insurance company -- receiving compensation for that isn't law in FL, but if its a big, national company (Geico, Progressive, etc.), they will be motivated to compensate you anyway, because it is law in some state where they operate, and company policies on dealing with diminished value tend to be across the board. Anyway, it sounds like you've endured a lot -- far more than most people can even begin to imagine enduring. Not everyone has the will to do that; you are a survivor. This whole thing with the shop is a really, really shitty situation, and your frustration and exasperation are very understandable. But it will definitely pass, you will definitely be ok, and you will definitely have a new Z soon. Good luck and hang in there!
