The recording capability is already in the current ECUs. I'm not sure when this capability was built in, but I'd guess that anything 2015 and newer is capable of 'black box' mode, ie.being able to download the last hour of vehicle data, to include speed, braking, rpm & other information. Welcome to the nanny state.
