I don't believe they even check if you don't blow a code but I am no expert on that part of title 28. Also if I am not mistaken modern cars are only test every 5 years so it should be easy (still a pain) to change things out come testing time.

California has some counties that don't have smog laws either, but then again most properties in those counties also don't have public utilities and are essentially off the grid.
I'm not sure about the modern cars law. I remember a dealer course I took (2011/2012) stated new vehicles are exempt for the first three years and you pay a smog abatement fee instead. Sounds like they must have changed this because I was wondering why I didn't have to smog and its my 4th year since purchase on my Nismo.
