DOT, FMCSA, NHSTA, they all have language similar to this (this came off one of those actually):

"Requirements for lamps other than head lamps, Lamps to be steady-burning. All exterior lamps (both required lamps and any additional lamps) shall be steady-burning with the exception of turn signal lamps"
I'm seeing an awful lot of flashing high mount brake lights stock from the factory, especially on Kia and Hyundai, so I'm not sure it's enforced. As long as it's just red, I would be comfortable running this, it would be the addition of another color, like blue or amber, that might get the popo down on you.
