Yeah... it's hard to tell from the one rear pic, but if there is sufficient damage to the rear right quarter, and almost anything to the frame, it's going to be a total loss, and it's probably better that way. I have a lot of time trusting heavily rebuilt vehicles... they just never feel *quite* the same afterwards.
Hopefully you didn't have any harm to yourself, but sometimes the stiffness and back/neck pain doesn't set in right away. Just remember, if you get a lawyer to handle the interaction with their insurance company, it automatically pays out triple for medical bills. (at least, it does here in Georgia).
Since you got rear ended, I don't think anyone is going to dispute that it's 100% the other guy's fault.
