I told him the basic story about what happened, and he said it'd be a difficult case to fight, but then I told him she didn't have a license and he changed his tone completely. So I guess that's a good thing. I'm hoping the police report is as on my side as the police were that night.

I wish there was a witness.
don't you have no fault insurance or coverage for uninsured motorist where you live? just have your company fix the car and avoid all the hassle and lawsuits and crap. and if you're not at fault like you claim, your premiums shouldn't increase.
