My 2 cents worth.
- The only person who will come out on top is the lawyer.
- If the dude's insurance sucked, I doubt they will just pay whatever amount your medical bills come to (Much less pain and suffering). They are in the business to make money (just like your lawyer).
- If the dude's insurance sucked, it could take a long time to see any money. In the meantime you will STILL have to pay medical bills etc. if your personal insurance won't cover it.
Personally, I would not lie about anything or take any unnecessary tests. If you think the insurance company lawyers don't know the tricks and ways people lie or where to look to find evidence of fraud (like lying) you are mistaken. Again, they (the insurance company's lawyers) are there to make sure they pay as LITTLE AS POSSIBLE or delay it as long as they can. Yes, there are big settlements and there are lots that aren't or take forever in court. Yes, you should be compensated fairly (money for loss of car, loss of work, stress/pain/etc) and your necessary medical bills handled. Just don't get greedy and wind up in a deeper hole than you can get out of.
