You are experiencing a misfire CEL from an aftermarket intake- this is an issue that is widespread and very, very common.
In this case, IMO, Nissan is in the right. You need to get a stock airbox. Chances are, when you change out the airbox, the CEL is going to stop tripping.
Your dealer is being much more helpful than any I've encountered when it comes to helping you with this CEL. By all means, they have the option to just deny service to you completely, but they're not doing that.
Follow what other posters have said and grab a stock airbox. Thank the dealer for their help tracking the issue down and bring in some pizza for them.
