That's a lot... especially with Nissan lowering the MSRP on '14's by 3K. There was new '13 Nismo on the lot when I bought my base sport. It had been there 6 months and they wanted to sell it badly. MSRP was about $44K, but I bet $40K would have bought it. They pushed me pretty hard towards the Nismo and said they'd make a heck of a deal on it but I wasn't interested. I did use the $3K lower '14 MSRP thing in my favor when I negotiated the price on my base sport. I think you could do better than $38K on a used Nismo with 13K on the clock.
