Nissan ended up only paying a payment as a "kind gesture" since it was a dealer issue (which is was). They did however contact the dealer and start things there.
I went to the dealer about a month ago.. and after about 2 hours of talking/explaining/negotiating... they agreed to do what I asked.
They took my 2009 370Z, which I owed $27,000 on. And they "gave" me a 2012 370 Touring Sport 6MT. Basically everything that my 2009 had. There were no Montery Blues anywhere around... so I ended up going with Gun Metallic.
They basically swapped out my loans. They took care of my 2009 and sold me the 2012 (MSRP $42,900) for $25,000 plus taxes and whichever.. which equaled to exactly what I owed on my 2009.
I could have gotten more out of going to a lawyer like many suggested... but as I told the dealer, I figured this would be the easiest solution for all involved. They eventually agreed. The entire process was pretty painless... just waiting for the the from out of state.
Everyone actually treated me very well. Glad it's over.
