Believe it or not there is actual judge school these idiot judges, most are small town or local little courts.
Unless the small claims court judge knows the law well, sometimes their lack of the law can go against you.
With a civil lawsuit it will allow you to sue for all damages and all attorney, court costs.
In most cases it will cost you about $500 to file a civil case, hopefully the insurance company or the collision shop will settle before they go to court.
Note once a bussiness or individual is served with papers on a civil lawsuit it costs a lot to defend, your position and most of the time its cheaper to just settle the case then to try and defend your position.
