thanks onzedge - yeah I'd not registered until i googled the problem and this thread came up!
BTW I actually got a voicemail from Nissan Consumer Affairs a short while ago in response to my email, the guy needs to collect part number, order number, etc - not sure why he didn't just contact the dealer
Oh and just got the following email:

* Part number
* Date the part was ordered
* Order number
* Date when the vehicle became inoperable
* Location of the vehicle
You may send this information to us in writing or you are welcome to call Nissan Consumer Affairs at 1-800-647-7261 and provide the information over the phone.
File # (removed) has been created to document your concern. Please reference this file number when you write or call.
When we receive the requested information from you, we will forward your file to a Regional Specialist for individual handling.
