Also it's at that time when you speak with the clerks office that you inform them that you want to proceed with a TBWD. They will give you the appropriate forms in order to move forward with that process.

When you do a TBWD you have to make sure that you serve the cop with a LENGTHY discovery request. CHECK with the clerks office regarding this because they usually have a standard one that must be filled out otherwise it won't get to the cop. If they don't require one, I have a PDF example you should use depending on how the cop determined your speed (radar, lidar, pace).

If you lose your TBWD, remember that you always have "trial de novo" which is another (court) trial. So it's like 2 chances for the price of one. I did a TBWD and lost and did a trial de novo and the cop didn't show... case dismissed!
